When writing a sci-fi novel, I wanted to use some cultural references to relate to the reader. I had chosen a song from a well-known rock artist and placed it in my early drafts. The lyrics inspired one particular point in the book, as well as context and setting. I polished this page up, added the artist’s name, and made it uniquely my own, except for the excerpt from the song, which was carefully cut, crafted, and timed in the motion of the narrative to bring the desired effect. And then, I began to question my use of the quote.
Trouble in the Paradise Narrative
It turns out you can’t quote lyrics in your book without permission from the original artist. You can reference the song title and the artist without any problem. The issue comes when you use the written lyrics of an artist. The very same copyright laws that will protect my work protect another’s, and it protects yours. The good news is that it was an early draft and wasn’t published. The artist inspired my work, and I removed the lyrics but left the reference to pay homage to the artist and their song.
A Common Mistake
Recently, two friends of mine reached out about their writing projects. Both have never met each other, and both didn’t realize quoting song lyrics can put you in jeopardy of copyright. It was interesting to learn that the same mistake I had made, the two other writers had also made. And that both were inspired to write based on the artists they chose to support their work. Anecdotally, this is why reading, listening, observing other artist’s work is important; it inspires. There are few exceptions, especially when a written work becomes public domain. Also, quoting something from another’s book can be used, provided properly sourced.
I found Vervante’s Fair Use Guide helpful for clarifying what can and can not be used.
Don’t feel discouraged. Use those song lyrics as a way to be inspired for your work and early drafts. Just remember to remove them before you publish your work.
